1. Agreement to Terms
Welcome to The Homeschool Feast, operated by A Gentle Feast LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at thehomeschoolfeast.com, our branded mobile application ("App"), and all related services, content, products, and features (collectively, the "Services").
By accessing or using our Services, creating an account, purchasing a membership or product, or downloading our App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Effective Date" above. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.
2. Description of Services
The Homeschool Feast provides Charlotte Mason-inspired homeschool curriculum, educational resources, digital products, and community features designed to support homeschooling families. Our
- Services include:
- Annual membership subscriptions providing access to curriculum lesson plans, morning time resources, teacher training materials, and community features
- Digital courses and masterclasses
- Downloadable digital products including PDFs, schedules, book lists, and planning resources
- Access to our branded mobile application
- Online community forums, meetups, and member events
3. Account Registration and Security
3.1 Account Creation
To access certain features of our Services, you must create an account. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security at [email protected].
3.3 Account Sharing
Your account is personal to you and may not be shared with others outside your immediate household. Each membership is intended for use by one family unit. Commercial use, resale, or redistribution of account access is strictly prohibited. Violation may result in termination and legal action. A Gentle Feast may repost Client’s social media comments for marketing purposes.
4. Membership Terms
4.1 Membership Structure
Our membership program operates on an annual subscription basis corresponding to academic cycles. Each membership grants access to curriculum materials for one cycle (school year). Access to subsequent cycles requires purchase of additional membership periods.
4.2 Billing and Payment
All payments are processed through our third-party payment processor. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees. Prices are subject to change with reasonable notice to existing members.
4.3 Membership Access Period
Your membership access begins upon successful payment and continues for the duration of the applicable subscription period. Access to membership content ends upon expiration of your subscription period unless renewed.
5. Purchases and Refund Policy
5.1 Digital Product Purchases
All purchases of digital products, courses, and downloadable materials are final upon delivery. Due to the immediately accessible nature of digital content, we do not offer refunds for digital product purchases once you have gained access to the content.
5.2 Chargebacks
If you initiate a chargeback or dispute with your payment provider rather than contacting us directly to resolve an issue, we reserve the right to immediately terminate your account access and pursue recovery of the disputed amount plus any associated fees.
6. Mobile Application Terms
6.1 App License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our App on devices you own or control, solely for your personal, non-commercial use in connection with accessing the Services.
6.2 App Store Terms
Your use of the App is also subject to the terms and conditions of the app store from which you download the App (Apple App Store or Google Play Store). In the event of a conflict between these Terms and the applicable app store terms regarding use of the App, these Terms shall control as between you and us.
6.3 App Updates
We may from time to time issue updates to the App. You agree to install such updates as they become available. Failure to update may result in inability to access certain features or content.
7. Intellectual Property Rights
7.1 Our Content
All content included in or made available through the Services, including but not limited to text, graphics, logos, images, audio clips, video clips, digital downloads, data compilations, curriculum materials, lesson plans, and software, is the property of A Gentle Feast LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
7.2 Limited License to You
Your purchase or membership grants you a limited, non-exclusive, non-transferable license to access and use the content solely for your personal, non-commercial homeschooling purposes within your immediate household. This license does not include the right to reproduce, distribute, publicly display, or create derivative works from any content, except as expressly permitted.
7.3 Prohibited Uses
You may not: (a) copy, reproduce, republish, or redistribute our content except for personal use within your household; (b) sell, resell, license, or commercialize any content; (c) share account credentials or content with individuals outside your household; (d) use content to create competing products or services; (e) remove any copyright, trademark, or other proprietary notices; or (f) use our content in any way that violates applicable law.
8. User Conduct and Community Guidelines
8.1 Acceptable Use
When using our community features, forums, or any interactive aspects of our Services, you agree to conduct yourself in a respectful, constructive manner that supports our community of homeschooling families. Our membership is a space for collaboration, encouragement, and support. We expect all members to:
- Treat others with kindness, respect, and grace.
- Avoid negative or inflammatory discussions, including personal attacks, offensive language, or disruptive behavior.
- Keep discussions on topic and relevant to homeschooling and personal growth.
- Respect the privacy and confidentiality of fellow members.
- Failure to uphold these community standards may result in the cancellation/refund of your membership.
8.2 Prohibited Conduct
You agree not to: (a) post content that is defamatory, obscene, abusive, threatening, or discriminatory; (b) harass, bully, or intimidate other users; (c) impersonate any person or entity; (d) post spam, advertisements, or promotional content without permission; (e) share personal information of others without consent; (f) upload viruses or malicious code; or (g) attempt to gain unauthorized access to any portion of the Services.
8.3 User Content
By posting content in our community areas, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display such content in connection with operating and promoting our Services. You represent that you own or have the necessary rights to post such content.
8.4 Moderation
We reserve the right to remove any user content and to suspend or terminate accounts that violate these Terms or our community guidelines, at our sole discretion and without prior notice.
9. Third-Party Services and Links
Our Services may contain links to third-party websites, services, or resources, including but not limited to YouTube videos, book recommendations, and educational resources. We do not control and are not responsible for the content, privacy policies, or practices of third-party services. Your use of such third-party services is at your own risk and subject to the terms and conditions of those services.
10. Disclaimers
10.1 Educational Content Disclaimer
Our curriculum and educational materials are provided as resources to support your homeschooling journey. We are not a licensed educational institution, and our materials do not constitute professional educational, legal, or child development advice. You are solely responsible for ensuring your homeschool program meets applicable state and local requirements.
10.2 No Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL A GENTLE FEAST LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless A Gentle Feast LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you post or submit through the Services.
13. Termination
13.1 Termination by You
You may terminate your account at any time by contacting us at [email protected]. Termination does not entitle you to a refund of any fees paid, except as expressly provided in our refund policy.
13.2 Termination by Us
We may suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease.
13.3 Effect of Termination
Upon termination, all licenses and rights granted to you under these Terms will immediately terminate. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact us at [email protected] to attempt to resolve any dispute informally. We will attempt to resolve disputes within 30 days of receiving your written notice.
14.2 Governing Law
These Terms and any dispute arising out of or related to these Terms or the Services shall be governed by the laws of the State of South Carolina, without regard to its conflict of law principles.
14.3 Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in South Carolina. You agree to waive any right to a jury trial or to participate in a class action.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and A Gentle Feast LLC regarding the Services.
15.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
